Terms of Service

These Terms of Service govern the use of the Lunory website, web and mobile app, operated by De Girardi GmbH (the Provider). By creating an account or using the service you accept these terms.

1. Scope and contracting party

Contracting party is De Girardi GmbH, Chnüpferweg 3, 8320 Fehraltorf, Switzerland. The brand under which the service is offered is Lunory.

2. Service

Lunory generates personalised stories with the help of artificial intelligence and provides them on the web and in the Lunory app. Content can be read on screen or played back as audio.

Generated content depends on the input provided by the user. Despite content filters and quality reviews, the Provider cannot guarantee that every story will be free of errors, factual inaccuracies or unintended elements.

3. Account and eligibility

An account requires registration with a valid email address. The user must be of legal age and fully able to enter into contracts. Lunory may be used by minors only under the responsibility and supervision of a parent or legal guardian who holds the account.

The user is responsible for keeping login credentials confidential and for all activity carried out under their account.

4. Acceptable use

The service may not be used to generate content that is illegal, harmful to minors, hateful, discriminatory, sexually explicit, violent, defamatory or that infringes third-party rights. The Provider may suspend or terminate accounts in case of abuse.

5. Rights to generated stories

The user receives a simple, non-exclusive, non-transferable licence to use the generated stories for private, non-commercial purposes within their family.

Underlying models, prompts, system instructions, code and the Lunory brand remain the property of the Provider and its sub-processors. Commercial use, resale or systematic redistribution require prior written consent.

6. Prices, subscriptions, renewal and cancellation

Prices and the scope of the free and paid plans are shown on the pricing page at the time of subscription. Paid plans renew automatically at the end of the chosen term until cancelled.

Cancellation is possible at any time with effect from the end of the current billing period. After cancellation, paid features remain available until the end of the paid period.

7. Right of withdrawal (EU consumers)

Consumers domiciled in the EU may have a statutory right of withdrawal for distance contracts. By starting to use the digital content during the withdrawal period, the consumer expressly agrees that performance begins immediately and acknowledges that the right of withdrawal is thereby extinguished.

8. Payment

Payments are processed by Stripe. The user agrees to Stripe's terms in addition to these Terms of Service for the payment process. Invoices are issued in electronic form.

9. Availability

The Provider strives to keep the service available without interruption but does not guarantee uninterrupted availability. Maintenance windows, technical issues at sub-processors or force majeure events may temporarily limit access.

10. Liability

The Provider is liable for damages caused by intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law. The Provider is in particular not liable for indirect or consequential damages, loss of profit or loss of data.

Mandatory liability under the Swiss Product Liability Act and for personal injury remains unaffected.

11. Changes to the service and terms

The Provider may further develop the service and adjust these Terms of Service. Material changes will be communicated by email or in the app at least 30 days in advance. If the user does not accept the changes, the user may terminate the contract at the time the changes take effect.

12. Final provisions

These Terms of Service are subject to Swiss law, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.

Exclusive place of jurisdiction is the registered seat of De Girardi GmbH (Pfäffikon ZH district), subject to mandatory consumer protection law.

Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall not be affected.
